Deadline approaching for comment on proposed permit governing water quality of construction sites statewide
 

After more than two years, the State Water Board has finally issued a draft permit, and it represents a substantial departure from the existing permit program. The deadline for public comment is approaching.

To aid you in understanding the proposed changes we have prepared a five page summary of the key procedural and substantive issues raised by the 120 page document.

There are new requirements for:

Public review of documents that can delay or prevent permit coverage
Numeric action levels and effluent limits that can lead to enforcement actions
Post-construction controls affecting the design of development
Requirements that will increase the cost of compliance including:
  - specific BMP requirements (including the need to install active treatment systems at certain sites)
  - more frequent monitoring
  - more documentation requirements
 

As discussed in the attachment, there are upcoming opportunities to present written and oral comments on the draft permit in mid-late April. 

 
The State Water Board has scheduled two workshops where oral comments will be accepted:
April 17, 2007 in Rancho Cucamonga
April 20, 2007 in Sacramento
April 27, 2007 is the written comment deadline.
