Timothy B. McGinity

Tim works with clients on commercial and high-end residential real estate projects to help deliver positive results that stand up to the toughest challenges and their most ambitious goals and requirements. He maintains a hybrid practice—deals and disputes—that is unique to the California real estate marketplace.

Tim represents institutions, businesses, and high-net-worth individuals, often actors, musicians, business managers, and others in the entertainment industry in multiple areas, including the purchase or sale of multimillion-dollar office, industrial, and residential real estate, as well as in matters associated with ownership, development, leasing, and building management.

Real Estate and Commercial Litigation

A decorated Navy veteran and Ironman triathlete, Tim brings discipline, diligence, leadership, and team skills to bear on his clients’ behalf in his real estate and commercial litigation practice. He is accustomed to accomplishing his clients' transactional goals and effectively working to satisfy his clients’ litigation objectives in cases that range from unlawful detainers, landlord-tenant disputes, and land use issues, to business contract disputes for institutions, businesses, and individuals.

While the core of Tim’s practice is to keep clients out of litigation, when problems do arise, his experience allows Tim to navigate his clients to the best result. For nearly a decade, working as outside counsel for a large national bank, Tim successfully supervised a multitude of litigation matters, quarterbacking local counsel in 15 states. Other cases he has worked over the years include representing financial institutions in forfeiture actions and individuals in highly contentious litigation—all of which tie into real estate in some form.

Real Estate Transactions

Tim’s combined focus rests on his extensive experience as a commercial litigator and significant work on large real estate transactions. He takes a 360-degree view when approaching a deal and assessing potential issues, such as those related to indemnity and release provisions. Long-standing clients defer to his judgment on these important matters and trust his ability to craft terms and documents that side-step costly disputes—a trust he has earned, built on his results.

Those results derive not only from collaborative teamwork with his clients but also with his Allen Matkins colleagues. He often works hand-in-hand with the real estate partners that possess specific technical knowledge, skill, or market relationships that can streamline and speed transactions.

Recent deals completed include the development and sale of a $50 million, seven-building industrial campus; a $26 million multi-family purchase; a $92 million office building purchase; and the purchase of an $85 million office park in Anaheim, California.

Whether closing a deal or successfully resolving a dispute, Tim takes great satisfaction in helping his clients, professionals with whom he shares mutual respect and long-term relationships.
