Law360 (July 2, 2015) All engines are firing in today's hot real estate markets, and amid the market noise, experts have pointed to eight trends — from sectors getting increased attention to shifts in dealmaking — that real estate attorneys should be in the know about. As the real estate market has picked up over the last handful of years, sellers have had more and more sway as the competition for good assets — particularly trophy properties — has heated up. “Some very aggressive buyers, because they are trying to distinguish themselves on the deal, will agree to sign and go hard,” said John M. Tipton, a partner with Allen Matkins Leck Gamble Mallory & Natsis LLP. It's not uncommon in top deals for bidders to be putting in the comments for purchase and sale agreements with their best and final bids and to have spent their money up front doing due diligence before knowing they are the winner, noted Tipton.
