Off With The ‘Handcuffs’: How A Noncompete Ban Could Change CRE

The clauses restrict workers from being employed by a competitor.  Grant explained that the ban will have an impact on the commercial real estate (CRE) industry, particularly on brokerage positions, development firms, and executive roles. The ban, aimed at fostering business formation and increasing worker wages, raises concerns in CRE about competitiveness, trade secrets, and early career training. Attempts at enforcing noncompete agreements often leads to prolonged litigation, with the balance often tipping in favor of employers.
