The project was recently approved by the Encinitas Planning Commission, but the Commission rejected the developer's request to avoid roadway improvements associated with the project. Speaking on behalf of the developer of the project, Tim argued that the "city had not met the legal standard required to deny the request to waive the roadway improvements."
