Tips and Traps When Negotiating a Favorable Lease for Your Company – a Tenant’s Perspective

Speaking Engagement

When

4.26.12

Where

San Francisco, California

When a tenant receives a landlord's draft of a lease, many provisions that look like "boilerplate," should be reviewed carefully and negotiated by the tenant. Other provisions that could be helpful to a tenant may be entirely absent from the landlord's draft. The panelists will share their views on the following topics, among others:

  • MOVE IN ISSUES such as: the Work Letter, Landlord’s Work, BOMA remeasurement issues, and the Commencement Date.
  • OPERATIONAL ISSUES such as: the use clause, operating covenants, parking, signage, and international jurisdictions.
  • RISK MANAGEMENT AND LIABILITY ISSUES such as: insurance, indemnity, subordination and estoppels, environmental issues, and compliance with laws.
  • EXIT STRATEGY ISSUES such as: kick out provisions, holdover rent, repair and removal of improvements and alterations, and assignment and sublet clauses.
