CalBRE/CC&Rs

We have significant experience in the strategic planning and document preparation for planned communities, condominiums, mixed-use projects and other common interest developments. Such work includes the documentation needed to establish the relationship and responsibilities of multiple parties sharing facilities, structures or common elements, including Reciprocal Easement Agreements (REAs), CC&Rs, shared cost agreements and the like.

EXPERIENCE

  • Providing guidance regarding Subdivision Map Act compliance and the association and condominium subdivision structure, whether the issues are phasing, vertical parcel maps, modules or multi-level condominiumization.
  • Assessing the client's construction risks and liabilities and developing a risk management program which is implemented in the various project documents, including construction contracts.
  • California Bureau of Real Estate ("CalBRE") processing, where our close work with clients, title companies, engineers, CalBRE processors, and budget consultants to create project CC&Rs enables prompt CalBRE approval.
  • In a residential context, helping clients establish marketing and sales programs in compliance with federal and state laws and educating clients regarding the myriad of documents that need to be provided to buyers, including the project disclosures.
  • Remaining involved with the project through the final close of escrow to deal with defaulting buyers, claims, construction and scheduling problems and questions regarding sales.
