Our goal is to efficiently solve our clients’ disputes as promptly and successfully as possible.

Whenever possible, we try to prevent disputes by advising and consulting at the contract negotiation, preparation and execution stages of the construction project. In addition, we help our clients protect themselves from lien and stop notice claims and/or protect themselves with their lien and stop notice rights.

We also assist clients in using construction bonds (performance, completion, payment, stop notice and mechanic’s lien, and stop notice release bonds). We regularly advise our clients on how to best take advantage of bonds for their particular projects.

Once a dispute has arisen, however, typical forms of resolution include:

  • Litigation 

We handle matters of all sizes, from small mechanic’s lien cases to multimillion-dollar construction claims.

EXPERIENCE

  • General Contractor. Represented a general contractor with a claim in excess of $35 million on a complex laboratory project. The claim involved more than 10 parties and was resolved through multi-day mediation before significant litigation.
  • General Contractor. Represented a general contractor in litigation involving multiple gas stations, and settling subcontractor claims for differing site conditions and delay.
  • Owner/Developer. Represented a large owner/developer of shopping malls on numerous projects, including managing multi-party litigation as local counsel.
  • Construction Manager. Represented a construction manager with respect to various public procurement and bid protest issues on a $1.5 billion public works hospital project.
  • General Contractor. Represented a general contractor in disputes with an owner over the construction, operation, and warranty obligations for a cogeneration power system.
