Committees of Creditors and Equity Holders

We help the committee provide independent oversight of the debtor in possession, evaluation of the operations and judgment about the best interest of the committee's constituency. In particular, we assist the committee in: 

• Scrutinizing the role of existing management in the context of motions regarding employee compensation and retention, motions to appoint a trustee or examiner 
• Evaluating and helping negotiate the pricing and other terms of post petition financing and cash-collateral use 
• Evaluating plan options and structures: valuation motions, asset sales, going concern, treatment of claims and interests 
• Considering alternatives to confirmation of a plan, such as motions to convert or dismiss the case 
• Prosecuting litigation on behalf of the estate
