“Ballot box planning” is the popular phrase for the growing use of local initiatives and referenda in California communities. From adopting local growth measures to authorizing major sporting arenas, this highly emotionalized and politicized area of law is fraught with procedural and substantive traps.

We work with clients to create highly sophisticated strategies and tactics. We draft ballot measures for their benefit, attack ballot measures that threaten their projects, and assist with countermeasures regarding already pending initiatives or referenda.

EXPERIENCE

  • City. Represented client in connection with land use ballot measure seeking to impose requirement that all residential development approvals in certain areas of the City be approved by the voters.
  • Retail Company. Represented major retail client in connection with obtaining land use approvals for new stores, including drafting and securing City approval of a successful ballot measure regarding the development of the store in East Palo Alto, California. 
  • Developer. Represented client in connection with development agreements, CEQA compliance, initiatives, local planning , water supply, state and federal endangered species, wetlands permitting, and state surplus lands issues for the development of a 440 acre master-planned community.
  • Developer. Represented the developer of a 12-acre high density, urban infill, mixed-use project with 474 residential units and 49,000 square feet of commercial use in connection with CEQA compliance, initiative and referendum issues, local political issues, and local entitlements.
