The Williamson Act sets forth provisions whereby landowners within locally designated agricultural preserves may voluntarily place restrictions on agricultural lands in exchange for tax reductions and other incentives. The disposition of a Williamson Act contract can be a major component in the development process.
EXPERIENCE
- Energy Developer. Represented client in securing permit from CEC for operation of 200 MW electrical power plant. Representation included negotiations with Alameda County and the Department of Conservation regarding Williamson Act compatibility.
- Property Owner. Represented client in Humboldt County in lawsuit brought by County alleging Subdivision Map Act and Williamson Act violations regarding sales of lots. Settled nuisance-based causes of action following separate trial.
