David M. Brooks

Partner

David is a partner in the Real Estate Group and is based in the firm’s New York office. His practice focuses on commercial leasing. David has represented numerous institutional and non-institutional owners, tenants, and developers in a wide range of complex commercial leasing and development transactions.

While his practice is national in scope, David regularly represents clients on some of the most high-profile and significant office leasing transactions that take place in New York City each year.

David is a sought-out speaker and has delivered presentations on timely topics in commercial leasing to influential real estate organizations, including the Real Estate Board of New York (REBNY) and the American Bar Association. He has also lectured at the Columbia Business School.

Prior to joining Allen Matkins, David practiced at a prominent AmLaw 100 firm. He is also a certified public accountant. Prior to his law practice, David pursued a successful career as a manager in the tax department of a Big Four public accounting firm. While there, he developed a niche in the area of real estate-related financial products, and a corresponding interest in real estate law.

Outside of the workplace, David devotes a considerable amount of time and resources to religious, civic and philanthropic pursuits both in and outside of his community, through his synagogue and various outreach, educational and charitable organizations.

Representative Office and Retail Lease Transactions

  • Represented the owner of “28 Liberty” (formerly known as One Chase Manhattan Plaza), in the lease-up of over 1.5 million square feet of office and retail space. Representative transactions have included leases with AIG (200,000+ RSF), Carter Ledyard, London Stock Exchange and Alamo Drafthouse.*
  • Represented the owners of 600 Lexington Avenue, New York, New York in connection with all leasing activity at the building.*
  • Represented Manhattan’s largest office landlord in lease transaction at 100 Park Avenue, 1185 Avenue of the Americas, 810 Seventh Avenue, 1350 Avenue of the Americas, 521 Fifth Avenue and 220 East 42nd Street.*
  • Represented the owner of 1120 Avenue of the Americas (i.e., the “Hippodrome Building”) in connection with all leasing activity at the building.*
  • Represented national institutional owner with respect to the initial lease-up of 1095 Avenue of the Americas, New York, New York, including a lease for 441,255 rentable square feet to a major insurance/financial services company and a lease for 234,328 rentable square feet to an AmLaw 100 firm.*
  • Represented Norway’s largest financial services group in its headquarters lease at 30 Hudson Yards in New York City.*
  • Represented a global technology company in the expansion of its New York City headquarters in the Empire State Building.*
  • Represented a global e-commerce site in its 200,000 square foot office lease in Brooklyn, New York. The transaction was reported to be among the largest office leases in Brooklyn at the time of signing.*
  • Representation of media company with its lease at 120 Wall Street, New York, New York, which was at the time the first major ad agency to move to the downtown financial district.*
  • Represented a luxury specialty retailer in a lease agreement for the return of its flagship store to downtown Manhattan.*
  • Represented international media/publishing company and its affiliated companies in connection with a numerous leasing transactions including its corporate headquarters at 1330 Avenue of the Americas which included façade/rooftop signage.*
  • Represented multi-national personal care company and its affiliated companies in connection with its office leases at 435 Hudson Street, Terminal Stores Building located at 224 12th Avenue and retail lease at 404 Fifth Avenue.*
  • As pro bono counsel to the owner/operator of the Intrepid Sea-Air-Space Museum, advised client Intrepid in connection with its lease with Hudson River Park Trust as well as the construction and maintenance of a pedestrian bridge over Route 9A at 46th Street, an eastern terminus for such bridge and an east side drop-off and bus layover facility between 45th - 46th Streets, New York, New York.*
  • Represented a publicly traded REIT in the leasing of 234,438 square feet of office space at 1095 Avenue of the Americas, New York.*

Representative Sale-Lease Back/Build-to-Suit Lease Transactions

  • Represented one of the largest financial services company in the following transactions:
      • Sale-leaseback of its headquarters for its markets and banking business located at 388 Greenwich Street and its global trading headquarters located at 390 Greenwich Street, comprising 2,634,670 rentable square feet in the aggregate.*
      • Sale-leaseback of approximately 75 branch bank properties in the New York Metropolitan area and California.*
      • Sale-leaseback of 338,409 rentable square foot office building located at 333 West 34th Street, New York, New York.*
      • Sale-leaseback of 371,627 rentable square foot office building located at 250 West Street, New York, New York.*
      • Sale-leaseback of One Court Square, a first-class office tower in Long Island City comprised of 1,401,630 rentable square feet.*
      • Development and net lease of build-to-suit call centers located in Boise, Idaho, Lexington, Kentucky, Fort Mill, South Carolina, and Greensboro, North Carolina, comprising approximately 700,000 square feet in the aggregate.*
      • Sale-leaseback of a 222,281 square foot Class A office building in Jacksonville, Florida.*
      • Sale-leaseback of a 264,022 square feet Class A office building in Farmington, Michigan.*

Representative Ground Lease Transactions

  • Represented the fee owner of the Graybar Building (420 Lexington Avenue) in connection with its long-term ground lease.*
  • Represented the fee owner of D&D Building (979 Third Avenue) in connection with its long-term ground lease.*
  • Represented fee owner of 61 Bond Street in connection with a long-term ground lease of land and hotel in downtown Brooklyn.*
