Alan D. Hearty

Partner

Alan, leader of the Century City litigation practice, is a seasoned trial lawyer with more than a quarter century of experience handling high-stakes litigation matters for a broad array of clients, including the owner of a National Hockey League franchise, California’s largest institutional landlord, a “big five” movie studio, a global wireless technology company, major financial institutions, and high-net worth individuals. Alan has tried many cases to verdict before juries and judges over the course of his career and has served as lead counsel in multiple high-profile matters. 

Alan’s notable trial successes include obtaining a complete defense verdict and a multi-million-dollar award for an institutional landlord after a five-week jury trial in which the plaintiff sought damages exceeding $50 million. Alan also obtained a multi-million-dollar award following an arbitration against a global medical company relating to its acquisition of a software development company. Alan further prevailed in a catastrophic injury case following a month-long trial and obtained a significant monetary award against the defendant as well as punitive damages.

Alan is a nationally recognized thought leader on complex real estate issues and has significant experience representing owners, developers, purchasers, sellers, investors, contractors, and brokerage companies in disparate litigation matters ranging from contract and partnership disputes to construction defect and professional negligence actions. Alan also has substantial experience litigating issues relating to luxury residential development, including restrictive covenant enforcement actions, easement disputes and entitlement challenges.

Alan is an accomplished leader in the community. He currently serves on the Executive Committee of the Century City Chamber of Commerce and on the Regional Advisory Board of the American Ireland Fund. He has been honored by the City of Los Angeles for his leadership in the Irish-American community and is a former recipient of the Irish Legal 100 Award. He was also named a “Go-To Thought Leader” by the National Law Journal in 2019, and was one of only 75 individuals recognized out of 100,000 potential honorees.

  • Software Company. Co-chaired three-week multi-party arbitration relating to breaches of an asset purchase agreement. Obtained complete defense verdict and a multi-million-dollar award on behalf of the corporate client and its principals.
  • Luxury Residential Property Developer. Lead trial counsel in major fee payment dispute with general contractor. Obtained complete defense verdict.
  • Landowner. Co-chaired two-week bench trial relating to complex easement dispute claims. Obtained complete defense verdict.
  • Corporate Dispute. Co-chaired bench trial relating to corporate director dispute. Obtained full amount of damages sought.
  • Movie Studio. Obtained summary judgment for Hollywood movie studio establishing that the client owned distribution rights to a major motion picture set for global theatrical release.
  • Global Telecom Company. Obtained summary judgment of potential billion-dollar nationwide class action for industry leading telecommunications provider.
  • Financial Institution. Successfully defended $1.3 billion dollar mezzanine foreclosure action on behalf of major financial institution.
  • Industrial Components Manufacturer. Obtained no-payment dismissal before trial of international manufacturer of water distribution components in multi-million-dollar asbestos product liability action.
  • Energy Company. Defended one of the world's largest energy companies in more than 30 lawsuits relating to alleged defects in water distribution component products.
  • Probate. Successfully defended appeal by former spouse of a deceased attorney who had sought to revoke her husband’s estate plan. Opinion was certified for publication by the California Court of Appeal, Second Appellate District. (Masry v. Masry (2008) 166 Cal. App. 4th 738, 82 Cal. Rptr. 3d 915.)
  • Global Telecom Companies. Outside counsel to several global telecom companies relating to various contested real estate matters.
