Jennifer Jeffers

Partner

Jennifer advises clients on land use and environmental matters arising from the development of commercial, residential, medical, and mixed-use projects in California, with a special emphasis on natural resources issues. She guides private, nonprofit, and public sector entities on all phases of project development from the earliest stages of design through completion, including acquisition, due diligence, California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) compliance, entitlement and permitting, and construction.

Jennifer is particularly adept at advising on complex natural resources matters, including those concerning endangered species and wetlands under the federal Clean Water Act (CWA), the California Porter-Cologne Water Quality Control Act, the federal Endangered Species Act and its California counterpart (ESA and CESA), and Section 1603 of the California Fish and Game Code (streambed alteration agreements). As part of this work, she regularly manages permitting with the U.S. Army Corps of Engineers, the U.S. Fish and Wildlife Service, the California Department of Fish and Wildlife, state and local water quality control boards, and the California Coastal Commission, among other federal and state agencies and local governments. Jennifer frequently advises clients (from both the project applicant and landowner side) on conservation easements and other similar mitigation approaches to achieve permit obligations.

She also has extensive experience with state housing legislation and local referenda, helping clients anticipate regulatory changes on the horizon. Jennifer has successfully ushered a diverse collection of high-profile projects through the state’s rigorous permitting approval process, including corporate campuses, mixed-use projects, hospitals and other healthcare facilities, and large residential developments.

Jennifer’s strong technical foundation, with undergraduate and graduate degrees in environmental science and previous environmental policy experience, aid in her ability to distil nuanced issues into pragmatic solutions. Prior to beginning her legal career, Jennifer established and implemented biodiversity conservation practices for governments and public institutions worldwide as the director of the Conservation International’s Regional Marine Strategies program in Washington, D.C. Before joining Allen Matkins, Jennifer was a partner and head of the land use practice at Stice & Block LLP in Oakland, California.

  • Medical. Serve as lead Northern California land use, CEQA, and entitlements counsel to the nation’s largest integrated managed care consortium and advise on the siting and development of major hospital and medical office facilities throughout California. Successfully obtained entitlements for new medical office buildings in Sacramento, Roseville, and Modesto; currently leading entitlement efforts for facilities in Manteca, Folsom, and San Rafael. Provide comprehensive counsel on property acquisition, CEQA compliance, and permitting strategy.
  • Residential Developer. Advised a leading California real estate company on the successful re-entitlement of a multi-family residential project in Sacramento. Assisted client with CEQA compliance, overlapping and complex development regulations, stakeholder engagement, and entitlement acquisition.
  • Public Utility. Represent client’s interests in connection with renewable company’s proposed geothermal facilities near the Salton Sea. Lead land use/permitting, natural resource, and tribal cultural resource negotiations between client and the project proponent, California Energy Commission (CEC), tribal representatives, and Imperial County. Advise on permitting and entitlement negotiations, natural resources and species strategy, water and utility agreements, and cultural resource mitigation negotiations.
  • Industrial Developer. Lead natural resources counsel for multiple industrial projects in Los Angeles County. Negotiate Lake and Streambed Alteration Agreements, oversee wetlands and species mitigation strategies, and engage with regulatory agencies including the US Army Corps of Engineers (USACE), California Department of Fish and Wildlife (CDFW), and Regional Water Quality Control Board. Review aquatic resource delineations and habitat conservation plan terms.
  • Global Engineering Company. Advise on solar development strategies at operational sites across California. Negotiate solar power purchase agreements (PPAs), interconnection agreements, and obtain local land use entitlements.
  • Financial Institution. Serve as local counsel on land use, natural resources, real estate, state property tax, and environmental due diligence and transactional issues in connection with the debt financing of new battery energy storage projects in Inyo County.
  • EV Travel Center Developer. Serve as land use and CEQA counsel for the development of a 30-acre electric vehicle (EV) and long-haul truck charging center in unincorporated Tehama County. Lead entitlement strategy and oversee CEQA review, permitting, interagency coordination, and compliance.
  • Mixed-Use Developer. Lead natural resources and entitlement counsel for a 52-acre mixed-use project in the City of Dublin involving residential, industrial, and commercial components. Coordinate with biological consultants, state and federal resource agencies, and City staff. Negotiate Development Agreement and structure mitigation measures for project impacts to special-status species, wetlands, and habitat.
  • Landowner. Drafted and negotiated a Mitigation Project Agreement and Conservation Easement related to the sale of 4,000 acres of client’s agricultural land in Colusa County to a third-party restoration firm for establishment of a mitigation bank.
  • Residential Developer. Represented capital management and real estate firm in the acquisition and conversion of a residential project in Oakland. Advised on the California Department of Real Estate (DRE) and Subdivision Map Act compliance.
  • International Gas Corporation. Provide CEQA, entitlements, and natural resource permitting counsel for development of hydrogen fuel infrastructure sites across Central and Southern California.
  • Residential Developer. Serve as lead land use and entitlements counsel for a multi-family housing project in Cupertino. Also advise on the conveyance of significant acreage of open space for conservation purposes and creation of new (c)(3) non-profit entity.
  • Residential Developer. Conducted land use due diligence for new residential projects in Cupertino and Mountain View. Advised on demolition and replacement unit requirements, affordable housing regulations, and tenant protections.
  • Technology Company. Serve as lead natural resources counsel for various San Francisco Bay Area office and R&D development projects for a multinational technology company.
  • Residential Developer. Direct natural resources strategy and permitting efforts for client on proposed residential project in Escondido. Coordinate with consultants and lead negotiations with the USFWS and City staff.
  • Private Individual. Advise a family trust on land use and natural resources issues related to leasing property from an environmental nonprofit. Provide guidance on the Williamson Act, conservation easements, and California Coastal Act considerations.
  • Residential Developers. Due diligence and city outreach efforts related to use of Senate Bill 1211, Senate Bill 684, and Senate Bill 1123 for proposed projects in Berkeley, Mountain View, and Los Angeles.
  • Mixed-Use Developer. Provide biological and aquatic resource permitting counsel for a proposed development in the City of Rancho Cucamonga.
